Mediation is the process that takes place when a neutral and impartial third-party mediator facilitates negotiation and communication between the parties in an effort to have them reach a resolution to their disputed issues. The mediator does not advise either party nor does the mediator decide the issues for the parties. Mediation is an opportunity for the parties to control the outcome of their case rather than having the judge decide for them. Attending mediation before a case is filed with the court is sometimes beneficial to the parties involved to avoid unnecessary costly litigation.
